We want to kindly remind all our customers who text homeowners that business-to-consumer texting is regulated by the Telephone Consumer Protection Act, or TCPA. Thus, care must be taken to ensure your texting campaigns aren’t violating the TCPA.
Presumably, if you are currently using texting functionality in any capacity, you already have robust TCPA compliance measures in place. At a minimum, in accordance with industry best practices, we strongly encourage our members to obtain express written opt-in consent before sending text messages to homeowners, only send text messages during daytime hours, and always comply with opt-out requests.
For more information about the background of the TCPA, compliance considerations and industry best practices, we recommend downloading and reviewing Twilio’s Guide to US SMS Compliance (Twilio is our bulk texting provider and their Guide is available for download here).
If you have any questions, please reach out to Customer Experience via email at [email protected] or phone at (877) 906-7575. Of course, each company’s situation is different, so your attorney would be able to provide more specific advice to you about how the TCPA impacts your particular texting campaigns, whether through Best Pick Reports or otherwise.
